Humane Design Global, LLC
This agreement is accepted once and covers your participation in Humane Design events for twelve months. It sits alongside our Terms of Service and Media Release. Where this agreement and the Terms of Service address the same subject, this agreement controls as between you and us.
The short version
We want you to actually read this, so here is the whole thing in six lines.
If anything here is unclear, ask us before you come. Write to humanedesignglobal@gmail.com and we’ll talk it through.
- We make music and dance experiences. They are social, physical, and sober. They are designed with care.
- They are not therapy or medical care. Our facilitators are not your therapist or your doctor, and nothing here replaces professional help.
- Moving your body carries risk. So does feeling something strongly. You are choosing to take that on.
- Sharing in a small-group conversation is always optional. Pass whenever you want. Don’t share anything you’d be hurt to hear repeated.
- We ask everyone to keep what is shared in small-group conversations private — but we cannot promise they will. We don’t control what other people do, and we film at our events.
- You are giving up the right to sue us for ordinary negligence. Not for gross negligence or willful misconduct.
1. What we offer
Humane Design Global, LLC produces sober live music and dance experiences to connect with yourself and others. Depending on the event, a session may include some or all of the following:
- Live music performed by the PULSE LIVE ensemble, or a recorded DJ set.
- Group dance and free movement, sometimes sustained over an extended period.
- Guided breath-based facilitation, periods of stillness, and spoken prompts.
- Sound experiences, including acoustic instruments and amplified sound at moderate to high volume, and in some settings vibroacoustic or haptic equipment you lie on or rest against.
- Optional partnered movement or contact improvisation, in which participants share weight and physical contact by mutual, ongoing consent.
- Closing small-group conversations in which participants may speak about their experience.
- Events held indoors, outdoors, and on public beaches, in varied terrain, weather, and lighting.
Our spaces are alcohol-free and drug-free.
2. What this is not
Please read this section carefully. It is the part people most often assume they already understand.
Our events are social, musical, and physical experiences. They are not treatment.
- Not therapy. Not psychotherapy, counseling, psychological or psychiatric care, group therapy, or any other form of mental health treatment.
- Not medical care. Not the diagnosis, treatment, cure, or management of any physical or mental health condition.
- Not a substitute for professional care. Nothing at our events replaces care from a licensed physician, therapist, or other qualified professional, and nothing a facilitator says is professional advice.
- Not a crisis service. We are not equipped to respond to psychiatric emergencies, acute crisis, or active risk of self-harm. If you are in crisis, call or text 988. If there is immediate danger, call 911.
- Not a promise of any outcome. We design carefully and we intend the experience to be meaningful. No specific emotional, physical, psychological, or therapeutic result is promised, guaranteed, or implied.
- Our language describes design, not treatment. We sometimes describe our work with terms drawn from neuroscience and somatic practice — nervous system, regulation, coherence, integration, and similar words. We use them to describe how an experience is built and what participants commonly report. They are not clinical claims, diagnoses, or promises of therapeutic effect.
- Our facilitators are not acting as clinicians. Our musicians, DJs, and space holders are trained in holding group experiences. They are not acting as your therapist, physician, counselor, or coach. A facilitator who holds a professional license in another setting is not practicing under that license at our events and does not become your provider by facilitating here.
No therapist-client, counselor-client, physician-patient, clergy-penitent, fiduciary, or other confidential or privileged relationship is created between you and Humane Design, its facilitators, its performers, or any other participant, by attending an event or by participating in any part of it.
3. Small-group conversations, sharing & confidentiality
Some events close with small-group conversations in which participants are invited to speak about their experience. This section governs those.
3.1 Sharing is voluntary
You choose whether to speak and what to say. “Pass” is a complete answer and needs no explanation. You may step out of a conversation at any time, and you may decline to be part of one at all.
3.2 Share at your own discretion
Please do not share anything you would be harmed by having repeated. You alone decide what you disclose, and by choosing to disclose it you accept the risk that it may be heard, remembered, discussed, or repeated by another person present.
3.3 What we ask of everyone
Each participant agrees, with every other participant, to the following:
- What is shared in a small-group conversation stays in that conversation.
- You may afterward speak freely about your own experience. You may not identify another participant, or repeat what another participant shared, outside the room.
- No attendee may photograph, film, screen-capture, or audio-record any small-group conversation at any time. (Humane Design may film — see Section 7.)
3.4 What we can and cannot promise
We hold this agreement seriously. We will state it aloud before every small-group conversation and we will act on breaches within our power, up to and including removing a participant from the event and barring them from future events.
We cannot guarantee it, and we will not pretend otherwise. Humane Design does not control the conduct of other attendees, is not a party to the agreement participants make with one another, and is not responsible or liable for any other person’s disclosure, repetition, or use of what you share. Humane Design also films at its events, including during small-group conversations, as described in Section 7. Humane Design makes no representation, warranty, or guarantee of confidentiality.
3.5 No professional or confidential relationship, and no privilege
Participating in a small-group conversation does not create a therapist-client, counselor-client, physician-patient, clergy-penitent, fiduciary, or other confidential or privileged relationship between you and Humane Design, its facilitators, or any other participant. No legal privilege of any kind attaches to anything said in a small-group conversation. Anything you say in one may be legally discoverable. A facilitator who holds a professional license in another setting is not acting in that capacity here.
3.6 Limits we are bound by
Where we learn of suspected abuse or neglect of a child, elder, or dependent adult; of a credible risk of serious harm to you or to another person; or where disclosure is required by law or legal process, we may be required to share information with the appropriate authorities or individuals. We will tell you when one of these limits applies wherever it is safe and practical to do so.
3.7 Release for disclosure claims
You release Humane Design from any claim, demand, or cause of action arising out of the disclosure, repetition, or use of anything you choose to share at an event — whether by another attendee, a facilitator, a performer, or any other person — except where caused by Humane Design’s own gross negligence or willful misconduct. If you disclose or repeat what another participant shared, you are responsible for the consequences of having done so, and Section 9 applies.
4. Assumption of risk
You understand that participation involves risks that cannot be eliminated no matter how carefully an event is run. These include, and are not limited to:
- Physical risks. Strain, sprain, fracture, collision with another participant or with objects, slips and falls, and injury from sustained physical exertion, overheating, or dehydration.
- Partnered movement. Contact improvisation and weight-sharing involve physical contact with another person and carry a risk of injury to you or to them, including from a fall, a drop, or a misjudged lift.
- Venue and terrain. Events held outdoors and on public beaches involve uneven ground, sand, rock, tides and proximity to water, weather, sun exposure, and limited or low lighting. Public spaces are not controlled by us.
- Sound. Amplified music and instruments at moderate to high volume, and vibroacoustic or haptic equipment. Prolonged exposure to loud sound carries a risk of hearing damage. Consider bringing your own hearing protection.
- Wireless headphones. At silent disco events you wear wireless headphones, which reduce your awareness of your surroundings, including other people, terrain, and water. Lift an ear or remove them when you need to move through the space or hear a facilitator.
- Breath-based facilitation. Breathing practices can cause lightheadedness, dizziness, tingling, muscle tension, changes in heart rate, and in uncommon cases fainting.
- Emotional activation. Music, movement, touch, and group settings can bring up strong emotion, distressing memories, a sense of vulnerability or exposure, or temporary disorientation — during the event and in the hours or days afterward. This is a known and ordinary feature of this kind of experience, not a malfunction of it, and you accept it as a risk of attending.
- Other people. The conduct of other attendees, including conduct that breaches our guidelines.
You knowingly and voluntarily assume all of these risks, known and unknown, and accept full responsibility for your participation.
5. Your health and your own judgment
You confirm that you have considered your own physical and mental fitness to participate and believe yourself fit to do so. You agree to consult a medical professional before attending if you have a history of seizures, cardiovascular or blood pressure conditions, recent surgery or injury, respiratory conditions, glaucoma or retinal conditions, a recent psychiatric crisis or hospitalization, or if you are or may be pregnant.
You agree to move at your own pace, to rest when you need to, to modify or sit out anything that does not feel right for you, and to stop if you experience pain, dizziness, or distress. You agree to tell a facilitator about any limitation, condition, or accommodation relevant to your safety. You remain responsible for your own wellbeing throughout.
6. Conduct
You agree to the following conduct rules:
- Consent is required and ongoing for all physical contact. “No” is a complete sentence and is honored immediately, without explanation.
- Our spaces are strictly platonic. Romantic, sexual, or predatory behavior will not be tolerated.
- Our spaces are alcohol-free and drug-free. Attending under the influence is grounds for removal.
- Attendee phones and cameras stay away for the duration of the event.
- You will follow facilitator direction, particularly during the opening, the closing, and the small-group conversations.
A facilitator may ask you to step outside, take a break, or leave entirely if your conduct compromises the safety of the room. No refund is owed in that case.
If something happens that makes you or someone else unsafe, tell a facilitator or the door host during the event, or report it afterward through our incident report form.
The Community Guidelines at humanedesignglobal.com/community-guidelines are the conduct standard at every event and are read aloud at the opening; they are part of these rules.
7. Photography, film & recording
We photograph, film, and record at our events for documentation, promotion, and archival purposes. This includes during small-group conversations. You grant Humane Design the right to use your image, voice, likeness, and movement, as further described in our Media Release.
If you would prefer not to be filmed, tell a facilitator or the door host before the small-group conversations begin and we will seat you out of frame and note your preference.
Publication limit for small-group conversations. We will not publish, post, broadcast, or distribute any footage or recording in which you are both identifiable and speaking in a small-group conversation, without your separate written consent given after the event. Footage of small-group conversations may otherwise be used for internal documentation, and as ambient or non-identifiable material.
Attendees may not photograph, film, or record at any point during an event.
If you prefer not to appear in our content at all, tell us at check-in and we will note it. You may also write to humanedesignglobal@gmail.com at any time and we will make reasonable efforts to remove you from material we control.
8. Release and limitation of liability
Read this section before accepting. It limits your legal rights.
In consideration of being permitted to participate, you release, waive, and discharge Humane Design Global, LLC and its members, managers, employees, contractors, facilitators, performers, volunteers, co-producers, and venue partners (together, the “Released Parties”) from any and all claims, demands, causes of action, and liability for injury, loss, or damage — physical, emotional, or financial — arising out of or connected with your attendance or participation, whether caused by the ordinary negligence of a Released Party or otherwise.
This release does not apply to gross negligence, recklessness, willful or intentional misconduct, or any liability that cannot be released under California law. Nothing here limits any right you have to report harm, to seek a remedy for harassment or assault, or to contact law enforcement.
You also expressly waive the protection of California Civil Code section 1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
To the maximum extent permitted by law, the Released Parties are not liable for indirect, incidental, special, or consequential damages, and their maximum aggregate liability for direct damages is limited to the amount you paid for the ticket in question.
9. Indemnity
You agree to indemnify and hold the Released Parties harmless from any claim brought against them arising out of your own conduct at an event, including your breach of the conduct rules in Section 6 and your disclosure or repetition of what another participant shared under Section 3.
10. Emergency contact and medical authorization
You authorize Humane Design to summon emergency medical care on your behalf if you are unable to do so, and you accept financial responsibility for the cost of that care. You agree to provide an emergency contact when you buy a ticket or reserve a spot, and confirm that person has agreed to be named.
11. General
- Minors. People under 18 are welcome only with a parent or legal guardian who attends with them for the whole event. The person accepting this agreement must be 18 or older. If you bring anyone under 18, you confirm that you are that minor’s parent or legal guardian, and you accept this agreement on their behalf, including the assumption of risk (Section 4), the release of liability (Section 8), the conduct rules (Section 6), and the Media Release (Section 7). You are responsible for the minor’s safety, supervision, and conduct at all times.
- Term. This agreement applies to every Humane Design event you attend for twelve months from the date you accept it, and to any Humane Design event thereafter until you notify us in writing that you revoke it.
- Scope. This agreement covers PULSE LIVE, WAVE, ARC, Silent Disco Ecstatic Dance, contact improvisation sessions, and other public Humane Design programming. Corporate engagements are governed by the relevant client agreement.
- Governing law. California law governs. Venue is Orange County, California, unless the parties agree to mediation or arbitration.
- Severability. If any provision is held unenforceable, the rest remains in force.
- Entire agreement. This agreement, together with the documents it incorporates by reference, is the entire agreement between you and Humane Design on these subjects.
Acknowledgement
I have read this agreement. I understand that Humane Design events are not therapy, medical care, or a substitute for professional care. I understand that confidentiality in small-group conversations is a community agreement that Humane Design does not and cannot guarantee, and that Humane Design films at its events. I understand that I am assuming risk and giving up legal rights. I am accepting freely.
You accept this agreement by checking the box when you buy a ticket or reserve a free spot. We keep a timestamped record of each acceptance and the version of this agreement you accepted.
